Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the website and/or the mobile application (the “Service/Product”) operated by Elke’s Estuary Aesthetics & Apothecary also known as (“us”, “we”, or “our”). 

Your access to use of the Service/Product is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all patients, visitors, users and others who access or use the Service. 

By accessing or using the Service/Product you agree to abide by, and be bound by, the most recent version of the Terms. If you disagree with any part of the Terms then you may not access the Service/Product. 

We reserve the right to modify or replace these Terms at any time. Changes at our sole discretion are periodically made to the information herein. You understand that information on the website is provided ‘as is’ for general information and that Elke’s Estuary Aesthetics & Apothecary and/or its suppliers may make improvements or changes in the website at any time. Elke’s Estuary Aesthetics & Apothecary and/or its suppliers make no representations about the availability, suitability, reliability, currency, completeness or accuracy of the information provided on the website. Our Service/Product may contain links to third-party websites or products that are not owned or operated by Elke’s Estuary Aesthetics & Apothecary. You agree that you will hold harmless Elke’s Estuary Aesthetics & Apothecary, its employees and suppliers from all claims arising from or related to your access or use of the Service/Product within this website and other websites that are linked. We are also held harmless if you are unable to use or access the Service/Product. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Elke’s Estuary Aesthetics & Apothecary shall not be responsible or liable, directly or indirectly for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on goods, services or content on or through any such websites or services.

Treatment Outcomes 

Elke’s Estuary Aesthetics & Apothecary strives to serve you to the best of our ability. The combination of art and medicine meet in advanced aesthetic treatments. The practice of art and medicine and how you may respond is not an exact science and will vary from person to person. Although good results are anticipated, there can be no guarantee or warranty, implied or promised by anyone as to the actual results you will or will not receive. Occasionally, additional services, treatments and/or products for furthered results or complications may be required. You could incur added charges in these instances that you would be responsible for. It is almost impossible to predict exact results, and therefore, payments made for services and products are made with the understanding that the investment put forth is for the product and its suggested use or the performance of the service or treatment and not for a specific result. 

Health Conditions 

Please disclose any underlying or new health conditions, concerns, allergies, injuries, or medications including natural herbs and vitamins and/or prescribed or over-the-counter medications, that could affect your service, treatment and/or treatment outcomes. We will ask for said information upon initial meeting and in writing through the intake form, however, if new conditions, allergies or injuries arise, or new medications including natural herbs and vitamins have been added to your regimen between the initial meeting and each future appointment, we must be advised verbally prior to performing a Service. 

Appointments and Advanced Reservations 

We are by appointment only. The most efficient way and preferred method to scheduling an appointment is through our online booking system. We highly recommend appointments be scheduled 4-6 weeks in advance to ensure that your preferred time(s) and service(s) are available. We also encourage showing up 15 minutes early for your first appointment so there is adequate time to fill out the intake form. In order to secure your desired time and service, we require a credit card on file, through our secured system. Your card will not be charged unless or until our Cancellation Policy below is broken. The card on file will be used strictly in the event of a late cancellation or a no-show and cannot be used to pay for treatments and/or products due to the card encryption within the secure system.

Late Appointments

If you are running late, respectfully give us a courtesy call to inform us. Your treatment will still end at the original scheduled time so as to not disturb the patients scheduled after you. If arrival time is anything past 15-minutes late, we will not be able to accommodate you. We wish to deliver superb results and rushing through a treatment goes against our operation guidelines. Late appointment arrivals past 15-minutes will result in canceling and rescheduling the appointment and it is possible that you will be charged a late cancellation fee. We cannot honor and proceed with appointments in which the arrival time is past the 15-minute mark because it is unfair for us to accommodate you and in return, run late for the patients after you. 

Cancellation Policy 

As a courtesy to other patients and the service provider, please give at least 24-hours notice of cancellation to avoid the card on file being charged. 24-hours notice is needed and appreciated so that if you cannot make your scheduled appointment, we may accommodate other patients. Confirmations must be completed 24-hours in advance through the email or phone call options we offer or we reserve the right to cancel the unconfirmed appointment and charge the card on file our late cancellation fee of $50. If a cancellation falls outside of our 24-hour policy for any reason other than an emergency, your card on file will be charged $50 or an invoice sent for $50. 

If a cancellation outside of our 24-hour policy occurs for a consultation, you will be charged or invoiced the late cancellation amount of $50 because although a treatment was not yet intended to be performed, the scheduled time given was set aside for consulting with you specifically, and if you do not show up, that is time we could have given to another patient. 

If a no-call, or no-show for a scheduled appointment occurs, we reserve the right to charge the card on file or invoice you for half the price of the scheduled service. Multiple no-shows will result in termination from our practice. We do not provide refunds for cancelled or missed appointments. 

We include provider-patient scheduling guidelines on all of our offerings so that it is clear if a treatment is a fit for you or not and how to prepare prior to your treatment. Please reference those guidelines when scheduling, and if you have questions, please contact us so we may assist you in answering those questions and/or scheduling. If you fail to follow these guidelines, we reserve the right to change your treatment to the best fitting, safest option available so as not to compromise your skin. Should you choose to not proceed with the suggested treatment instead, and if you would rather cancel your appointment, a late cancellation fee will be charged to the card on file to account for the time set aside to perform an intended or suggested treatment. We wish to serve you in a way that keeps you and your skin safe and leads to optimal results, and this is why we provide scheduling guidelines, however, if you decide not to follow them, and neglect our suggestion to proceed with a different treatment instead, we must account for the allotted time lost. 

Patients must have a valid email and phone number for confirmation purposes as well as a current card on file or risk their appointments being cancelled without notice, in addition to being suspended from scheduling future appointments. I hereby authorize Elke’s Estuary Aesthetics & Apothecary to process credit card payments through the card on file should I fail to confirm, be late, cancel outside of the 24-hour window, or no-show my appointment. This authorization comes with the understanding that credit cards will not be charged without due cause. 

Consultations 

Schedule a 30-45 minute consultation for $50. It is best to show up for your consultation make-up free so we can make the most out of our time together. Please show up 15 minutes early for paperwork.

We will

  • get to know each other, your lifestyle, skin desires and goals

  • perform a skin analysis and before photos to keep track of your progress

  • access the areas I can support you with in your skin journey

  • discuss skincare products

  • what you’re currently using and how we will slowly cycle out, and change some, or all of your products

  • create a customized treatment plan 

You will be set up to succeed! Timelines, realistic expectations, pre and post care, questions and concerns will all be addressed during your consultation.

Consultation and same-day treatment. No charge for consultation, price will be based on the treatment the provider and patient decide on in addition to all of the aspects of a consultation, prior to the chosen treatment. 

Please refer to our cancellation policy section above in regard to consultation cancellations. (“If a cancellation outside of our 24-hour policy occurs for a consultation, you will be charged or invoiced the late cancellation amount of $50 because…”)

Payment

We accept Cash, Visa, Mastercard, Venmo or our online Gift Card payments. We do not accept checks. Gratuity on services performed, and as a reflection of how much you enjoyed your treatment with us are tremendously appreciated.

Returns 

Skincare Products: If you are not fully satisfied with a product purchase from our store, please bring your receipt and product back within one week of the purchase. We will gladly apply the paid amount towards a product you wish to exchange the undesired product with, or apply the balance towards a future treatment with us. Unfortunately, we cannot issue a cash or card refund on used products or products returned after one week. 

Apothecary Products (especially anything intended for internal use): We do not offer returns or exchanges on opened and/or used apothecary products due to health and safety standards. Thank you for your understanding.

Patient Experience 

We enjoy having you in our space and serving you, however, we reserve the right to refuse service to anyone at any time for any given reason whether that reason is verbally communicated or not. To best serve you and ensure an optimal experience, please show up 5-10 minutes early for services and come without valuable, personal belongings. We are not responsible for lost or stolen valuables. Minors under the age of 18 must be accompanied by an adult, otherwise, bringing extra guests to appointments is not permitted due to the fact that our space is limited and we wish to uphold the safest space possible. We include provider-patient scheduling guidelines on all of our offerings so that it is clear if a treatment is a fit for you or not.
